Pedestrian Protection: Phase II feasibility study released

The Pedestrian Protection Directive 2003/102/EC required the Commission to carry out an independent study into the feasibility of Phase II of the Directive. The study examines the feasibility of Phase II provisions and any possible alternative measures, whether passive or a combination of both active and passive, which would be at least equivalent in terms of actual effectiveness. The independent study commissioned to comply with this requirement has now been received by the Commission and stakeholders are invited to participate in an open consultation on its recommendations.

 

The Directive on Pedestrian Protection is implemented over two phases. A first level of requirements will be introduced in 2005 (Phase I). This will be followed by more onerous requirements, based on advanced research and development, to be implemented in 2010 (Phase II).

 

The Directive recognises, in Article 5, that further consideration should be given to the technical requirements of Phase II. If necessary, an amendment should be proposed to allow a feasible application of the requirements whilst maintaining the level of protection afforded to both the vulnerable road user and the vehicle occupant. This may be achieved by use of alternative measures, either passive or a combination of both active and passive measures, which are at least equivalent in terms of actual effectiveness.

 

An initial review of the Commission study indicates that it will be necessary, from a technical standpoint, to propose amendments to the requirements of Phase II. Before proposing any amendments, the Commission wishes to complete its review by holding a public stakeholder consultation on the study and its implications.  The consultation includes the provision of the independent study.  Stakeholders are expected to submit their comments by 15 October.  If you would like to participate, please send an e-mail to entr-ped-prot-automotive-industr@cec.eu.int using the message “Phase II Feasibility” in the subject line.Following the consultation the Commission may present a proposal for amendment of the Directive.
